The cross-border exchange of goods may be subject to legal bans and licensing requirements in order to protect international security and the peaceful coexistence of peoples. This applies in particular to so-called industrial dual-use goods, but also to armaments; country-specific embargoes also include a large number of bans on sales, deliveries and services.
The respective restrictions generally relate not only to the delivery of goods, but also to the electronic provision of associated “technology”, whereby “specific technical knowledge required for the development, manufacture or use of a product” is expressly meant here. This can be production documents, technical drawings, recipes, repair instructions, etc. relating to a listed product, which are made available via upload, email or cloud, for example.
Furthermore, restrictions that may result from the respective end use must also be observed for non-listed goods and technical services such as training, transfer of knowledge or similar (so-called technical assistance). Activities in connection with NBC weapons, carrier technology for these or with a military or civilian nuclear connection are particularly critical and subject to approval.
Every user who uses this platform provided by PNO is responsible for the permissibility of the provision of their content under export control law. This applies in particular to any licensing requirements or prohibitions under export control law as described above.
PNO expressly reserves the right to exclude users and members from participation if there are indications of non-compliance with export control regulations.
